My Apologies if this seems a bit rude to you...
IV is specific for people those who are awaiting permanent residence...but looking at the recent set of events for those who are not in queue and are new here with just 2-3 years of stay in State....on H1B...
Following is happening and it has a reason...I know many of my friends who have been denied H1B, L1 extensions ..these are those people who have just started PERM...
EB2 dates moving to Jan 00 and other not under U, has a specific reason as well; quota is one reason but it is not the only reason in the current state...these is another means to make sure that those who are trying to get GC and other who are trying to stay for 6 years under H1B should be putup into a spot that the thought of leaving this place and ending up back home becomes a reality..
I am sure out of total 500K awaiting the GC process, will have now atleast a second thought of going back home...H1B and L1 under 6 years are now also being forced to return back....

Guys thanks for your appriciation on my recent blog "Power Behind A Flower". Please note that the reason behind this writing is to help our movement and encourage people to fight against injustice. Now the question is what's next??
With a successful flower campaign to USCIS, we must draw our conclusions from this success, and use the outcome to make the San Jose rally a success.
Please note that legal immigrants is a small handful set of people. Just a usual rally/demonstration will not make a dramatic impact. We have learned from the flower campaign that if we use innovative-peaceful ways of demonstrations, and manage Public Relations and Media well, we can be successful once again.
Please think and try to come up with some ideas. I have come up with these four ideas:
1. Project Martin Luther King Jr. as our hero in these rallies: Please understand that local Amrican people better understand about Martin Luther King Jr. andhis idealogy then M.K. Gandhi. My suggestion is that we should include large picture posters of Martin Luther King Jr. with a slogan "We legals too have a dream". We should also take Gandhi's posters. There is a possibility that all Black American organization may lend their support to us.
2. An act that attracts media attention: Please remember the scene from Gandhi movie when protesters led by Gandhi peacefully burned their resident permits in South Africa. To do something similar and show our symbolic protest against USCIS, we can publically burn a Photocopy of our H1B approvals (I-797). Please note that we are not asking people to burn the original I-797 approval but a photocopy of the document. This will send a message that taking the great pain in obtaining these legal documents are not helping us getting a better treatment by USCIS. This act will perfectly portrey the pain of legal immigrants and once again will attract media and newsprint to keeps us in headlines. This should be part of our demonstrations.
3. Waive American Flags: Please understand that recent media reports that only Indians are responsible for the flower campaign may hurt the campaign in the longer term. Please waive small American flags and show our solidarity with local Americans.
4. Distrubute a flower with a pamphlet to the people passing by at the demonstration site. A well worded paper will be required that can project our problems to the people.
Please share if you come up with innovative ideas to make these rallies a huge success.

I have changed my employer and my new employer got me an extn also my GC is filed by them. Do u have the similar case?

What exactly is the point of this rambling debate? Does anybody really thinks he/she can make an EB2 see the point of view of EB3 or vice-a-versa? No amount of legal/moral/philosophical arguments is going to convince the other party and we all know it.
All this debate has done is to bring out the ugliest side of all of us to the surface. There are EB2s claiming every EB2 is by definition superior than EB3 which is insane. And there is an EB3 who is itching to take help of none other than Ron Hira to shot down somebody's GC application as a retribution and couple of people applauding him for the brilliant idea! Really? Do we really thinks this is such a grand idea?
Just accept that everyone's only guiding principle here is self interest and move along. No need to jump through hoops to interpret the immigration law in 101 different ways and no need to call attention to personal suffering and plight. If we do really believe personal suffering should take precedence over everything else on humanitarian grounds then lets all first fight for illegal immigrants since their suffering is much worse than anyone here!

You cannot quote a post which is day old and ask the question "what are the hearings for?". Apparently the post you are quoting is made before the news came out that the hearings will be held. Is this GC thing getting on your nerves:)
Good if it happens. But when? What makes it to say it is dead for the lawmakers. If it is likely to be dead by the end of July, then what for the hearings in the month of august before the next recession? No hopes for anything, until something is signed by the president. Any new BILL, agian the same senate, congress, commitee process and KILL it at the end. Hmmm it is just my frustration and I am not blaming anyone. I am there to fight till the end(?? I dunno where the end is though).
Now to the big question, as of today, what is the status of CIR Bill. The hearings will be held in the month of August (House Folks are planning to call in the Senate Members to testify in these hearings, which is impossible because the Senate will be in Recess in the Month of August).
So the most optimistic guess would be that the hearings will be stretched into September. In October, the Senate (I'm assuming even the house) will go on recess again for the elections in November. Once the hearings end (September) and the elections end, depending on who will control the majority, the CIR bill will be brought into day light. The reason I say this is because CIR is the only way, as of now, they are dealing with the border problem. They have no choice but to address the border problem, for security reasons.
So the CIR will be discussed again, optimistically, in december. The House will name the conference committee members and schedule the conference committee. The conference committee may meet and discuss the differences in December/January. I'm confident that both chambers of congress will be more comfortable to deal with CIR after the elections. As I have said earlier, they have no choice but come up with some kind of border security legislation out of the conference committee. Optimistically, CIR may become law by next summer and it would be helpful for us, if our provisions survive the storm.
I agree with the "Passing under the radar" philosophy put forward by IV Core Team. Our best bet is CIR compared to other explicit bills like SKIL. Besides, if I understand SKIL correctly, it benifits only folks with Master's degree in US and 3 years of work experience in a related field (I do have this). So that is not a comprehensive solution for IV members.
The anti-immigration and outsourcing sentiment is high in this country now. Also, the corporations are only lobbying for H-1B visas. They will never lobby for GC's. It's against their interests for us to get GC's. So we, the GC seekers, are on our own. IV membership is below 5000 and our contributions are around 130K. IMO, this is not enough to influence the president to sign an emergency relief bill (someone suggested this) or even lobby the Congress for explicit bills like SKIL.
The best thing that we can do as of now is to get personally involved in recruiting more members for IV. I've pledged to myself that by the end of July, I'll ensure that I'll recruit 10 new members for IV. If we can get our membership atleast close to 50000 by the end of this year then we can make some significant noise.
So our options are:
1) To wait until next summer for CIR
2) EB3 folks with PD's as 2003 or higher, try to find a new job and file as EB2
3) EB2 folks with PD's 2004 or higher, try to find a new job that'll file for GC within 6 months
4) People who are in 7/8/9 years extensions of H1-B, consult good immigration lawyers and weigh in your options. The worst case scenario for you is to stick with your current firm as long as it takes for your GC. But there is no harm in trying, you may end up finding other viable options.

Your employer do NOT have to give LC or Original 140 to you for invoking AC21. If you have 485/AOS receipt ( which is your personal property) and you got a copy of 140 receipt ( if not approved) / copy of approval notice and that 485 shows more than 180 days from RECEIPT DATE you are good to switch Jobs.
Just keep in touch with Attorney in case if any RFE comes - so that he contacts you now instead of your previous employer. If you are a self-filer or have hired your own Lawyer even you dont have this headache.
When changing Jobs - be responsible on your own , so that you can respond to the RFE satisfactorily. Also make sure you get a letter from new employer that they want to recruit you on a permanent basis quoting your Salary and Job description.

I think IV needs to hire a good immigration attorney. May be IV can start a new funding drive to see, if members are really interested this hiring an attorney. The same attorney also can help us by answering our questions.

In my opinion, we need to have separate efforts for EB3 (now that EB3 I and EB3 ROW are in the same boat). If we have someone with leadership qualities and wants to use some social networking site for discussing EB3 issues and identifying approaches to solve the EB3 issues, there will be many EB3 folks willing to support the effort. Immivoice is just useless portal, it doesn't have open forums and the core folks here don't care for EB3. In fact, their lobbying efforts were behind USCIS changing the rule for spilling over the unused visa numbers to EB2 first. Just my 2 cents.

Guys I am looking at this thread for the first time today and want to put some comments:
1) 3 people were making hunger strike at SJSU over the last weekend for DREAM act and we come to know about it thru 1510 AM, KLIVE in Bay Area.
2) Immigration Voice members are planning to make a rally in SJ and we need to read it in the forum of (only) their website.
3) We are hungry about media coverage and want utmost attention of the congressmen about our issues.
BUT, you know what we are missing?:
1) No postings on the windows of those Bharat Bajars and Cash N Carrys and Kumuds. Can't the i-phone designers and router gurus make Ashas and Abhijeets invisible with some eye catching posters?
2) No postings on those other popular websites like murthy.com, immigration-law.com, bata.org etc. Did they say no for this?
3) No usage of the library notice boards.
4) No usage of SMS. Isn't it much cheaper than making contributions to the IV repeatedly?
I hope to see all these channels being utilized fully for July 14/21 march in Bay Area before we talk about CNNs and WPs.
Once the streets of SJ are hit with 1000+ people, those NBCs and CNNs and SJMs will come to us rather than we going to them.
As for myself, I am in whenever the event takes place and will try to bring at least 5 of my friends to the march.
P.S.: This is not an effort to criticize anyone here but just an attempt to help the organizers in whatever way I can.

Yes, but the immigration hearings already happened. People already have a clear indication on what the public wants. Lou Dobbs is still out there reminding them. Honestly, I wish us good luck, but I am not sure.
Seems like you are indicating that public clearly against CIR: on what basis you are saying that. There was no referendum and even an election after the CIR debate. Most of the opinion polls are evenly split: if I remember correctly a popular opinion poll said that most Americans want to solve the immigration issue and they also are fine with putting illegal immigrants on path to citizenship. They also want to have more border security provisions � most of these aspects are covered in CIR. Of course illegal immigration issue is controversial and CIR may never succeed in its current form irrespective of who is in control of congress. A democrat leading congress may not venture into too controversial aspects of immigration fearing a backlash during presidential elections. The backlash they fear is energizing the extreme right wing. A republican leading congress anyway won�t pass CIR bill.
That�s why our best bet is SKILL bill � this is relatively non-controversial, good for American industry, and supported by different groups. Of course it is very difficult.
Not sure if such an important bill will be taken up during lame-duck session. In fact the outgoing house members may actually push for some aggressive border security measures to make the process even longer than it is now. So yes�.I too wish us good luck we do need it a lot.

Why are you not taking EB1 into account where the diff is 9 - 10 years. I came to US on L1 in 2001 Then applied for EB3 in 2004 which was deneied in 2006. Then started in EB2 in 2006. So if you consider, I have been here since 2001 not that I just come in 2006. Like the same way you too move up in your career and then apply for EB2.
There is no reason people who are here from 1999, and still does not have a GC, for a person who is EB2- 2006 why USCIS give priority? Let EB2 and Eb3 category move hand in hand they already gave some relief to EB2, now they should move EB-3, people are waiting whose priroty dates are Year 2002, but if a EB-2 just came on 2007 gets Green Card that is unfair, One year gap is ok between Eb-2 & EB-3 but not 5 years.
I personally believe there are limitations for IV or any other organisation to influence the Political and Economic force that are existing in this world nowadays. Even if we lobby even if we talk, even if we gather, if those kind of forces are not benefitted in the form of votes(for power)(lobbying economically also depends on the personality of that person who you want to influence) nothing solid is going to happen. That is the TRUTH. But TRUTH sometimes is undigestable and it hurts a lot, and especially people who is having an agenda it hurts a lot! Employer can revoke I-140 anytime until I-485 is approved. After 180 calendar days of I-485 filing date, employee can continue I-485 seeking AC-21 protection . Employee must have open permanent job offer from another employer. The new job must be same or similar.

LoL. He is not even aware of the law. Employee is required join AFTER getting the green card, not before.

I think attorneys scare us in using AC21 before I-140. If you have a good attroney she can argue and convince USCIS to approve AC21 before I-140 approval. There can be only 3 reasons of I-140 denial:
- Ability to Pay
- Education
- Experience
Now if you work for a public company, A2P is not an issue. If you have a US degree, or a 4 years degree from outside, educations should not be a concern, unless LC asks for BTech in Comp Sc and you have it in Civil Engg. Laslty on Exp letter, if the only experience you mentioned on LC is the experience for which you have exp letter, you are fine.
Does anyone see anything missing? Come Jan 08, I expect many AC21 with I-140 pending.
